Respected Sir, One of my clients has received a excise transit sale invoice in which our supplier who is a non-excisable trader is mentioned as consignee & in the delivery box there is our address to receive the goods so the question arises that can I take the credit of excise on the invoice.Please reply.

From the question it appears that goods has been received under an excise invoice in which the consignee is non excisable trader and delivery address is of the customer. By applying the proviso to rule 9(2) of Cenvat Credit Rules 2004 if the conditions therein are satisfied the AC/DC of Central excise may allow the credit.
